Is Your Packaging Compliant?

Here’s a quick quiz for you:

  1. What information on your label must be in both French and English?
  2. What information must be placed on the principal display panel?
  3. Does the required minimum type height vary with the size of the principal display panel?
  4. Can you have both metric and Imperial measures on your label?
  5. Can you refer to the Food & Drugs Act & Regulations on your label?
  6. Is the US Nutrition Facts Panel identical to the Canadian Nutrition Facts Panel?
  7. Is the US Supplement Facts Panel permitted on the natural health products sold in Canada?
  8. Is mustard a priority allergen in Canada? The United States?

Is Your Website Compliant?

sourcesite-270x300In order to extend their marketing reach companies often put website links on their product labels; however, if you do this, the website must also be in compliance with relevant laws and guidelines. If a health claim for example, is not permitted on your label, then it is also not permitted on your website. Health Canada has taken to reviewing websites of companies selling products in Canada so they can see how you really intend on marketing the product. Depending on the type of products you are selling you may need distinct websites for Canada, the United States and any other jurisdictions that you are selling into.

Did You Know?

Pom Wonderful is suing Coca-Cola under the Lanham Act; a law that allows companies to sue competitors that misrepresent their products. In this case, Coca Cola’s Pomegranate Blueberry beverage is under attack. In spite of its name, the beverage contains 0.3 % pomegranate juice, 0.2 % blueberry juice, and 99.4 % apple juice. Pom Wonderful, a company that has built its reputation on the healthful benefits of pomegranate juice is taking exception to this type of practice in the marketplace. In Coca Cola’s defence they say that their label is in compliance with the Food & Drug Administration’s (FDA) labelling practices and that they are allowed to label the product based on its flavor, rather than on its composition. Regardless of the legal outcome it will have significant implications for the food and beverage industry in the United States.
