What’s Trending in Today’s Natural Products Market?

Electronic Cigarettes

Similar to medical marihuana, electronic cigarettes are a controversial topic. However, no matter where you personally stand on the issue, there is a growing consumer demand for both of these products. Source Nutraceutical, Inc. is involved on both fronts, but it is the e-cigarette industry that is currently keeping us hopping. As the regulatory environments change and mature around the world, companies are keen to identify and stake out their market share. The main regulatory question is how the products should or will be classified- are they tobacco products or medical products? The European Union appears to be leaving the decision up to companies as to how to position their products-either as medicinal products if they are promoted to help the user quit smoking or as tobacco products, if no therapeutic claims are made. Health Canada is facing a similar quandary as to how to most appropriately regulate nicotine containing e-cigarettes. Products without nicotine are considered consumer products and aside from compliant, bilingual labeling do not require premarket notification or licensing. Nicotine containing products however, face a tougher battle to get to market, as there is no one regulatory framework that addresses their unique characteristics. Given the consumer demand for e-cigarettes and their documented efficacy in smoking reduction and/or cessation (in clinical trials), coupled with reduced harm to the user, it is anticipated that Ministerial input will be required to provide an adequate solution to all.

In the interim, Source Nutraceutical, Inc. is heading to China in the fall to do a site audit of the manufacturing facilities in China and continuing to working closely with Health Canada and European Union regulatory associates to help our clients gain legal access to the Canadian and European markets.

Fibre

Recent changes to the definition of fibre and Health Canada’s position on novel fibres has opened the door for new products to enter the Canadian marketplace. Source Nutraceutical, Inc. is helping our clients to take advantage of these changes and bring innovative products to the Canadian market.

A 2012 dietary intake survey by Health Canada shows fibre intakes for all age groups and genders to be less than adequate based on 14g fibre / 1000 kcal / day. Although the consumption data does not include functional fibre (isolated, extracted, or synthetic fibre added to foods) and thus may be on the low side, Health Canada still maintains that the importance of an appropriate fibre intake should be promoted to the Canadian population. Thus the need for healthy, great tasting fibre based / containing products continues to increase.

NHP Compliance Deadline – Are you ready?

Its finally here – full implementation and enforcement of the Natural Health Products Regulations takes effect September 1, 2014. At this time all natural health products, throughout the entire distribution chain, are expected to be in full compliance with the Natural Health Products Regulations.

What does this mean? It means that all products must be licensed (have a DIN-HM or NPN), have compliant and bilingual labeling, contain only those ingredients that are declared on the label (medicinal and non-medicinal ingredients) and have claims that are consistent with the terms of your market authorization.

Although the Natural Health Products Regulations were passed into law in 2004, the regulatory requirement of having a product license prior to going to market has not been actively enforced for a variety of reasons. Moving forward, companies will be required to have product licenses before putting their products in the market and retailers will be expected to verify that the natural health products they sell are licensed. Further, products must be manufactured, packaged, labelled and imported by facilities with valid Site Licenses, meaning that they comply with Good Manufacturing Practices (GMPs) for natural health products.

The Natural Health Products Directorate (NHPD) has changed its name to the Natural and Non-prescription Health Products Directorate (NNHPD). This comes as a result of the NHPD’s recently expanded mandate to include the oversight of non-prescription and disinfectant drugs in addition to natural health products (NHPs).
